ADC-NJ Commends Attorney General Peter Harvey for Anti-Profiling Directive

The New Jersey Chapter of American-Arab Anti-Discrimination Committee (ADC-NJ)  commends New Jersey Attorney General Peter Harvey for issuing a Directive on December 20, 2005 “to Prevent Racial, Ethnic and Religious Profiling in the Course of Conducting Counter-Terrorism Investigations and Intelligence Collection.” 

The Directive prohibits the New Jersey Office of Counter-Terrorism or any other law enforcement agency acting under New Jersey law from considering an individual’s race, ethnicity, religious affiliation or religious practice as a factor in drawing an inference or conclusion of his involvement in terrorist activity, except in connection with investigation of a specific suspect.  The directive furthermore requires that Office of Counter-Terrorism personnel receive training regarding procedures to implement the Directive and regarding submission of data into the Statewide Intelligence Management System (SIMS), a database that assists law enforcement in terrorism investigation.   

The Directive follows Star Ledger reports earlier this year that the names of certain individuals may have been submitted to the SIMS database based only on the individuals’ religious affiliations.  The reports caused concern throughout the Arab American and Muslim communities that community members would be categorized as potential terrorist suspects merely by attending mosques or being active in religious or ethnic organizations. 

ADC-NJ thanks the Attorney General for clearly establishing that the State of New Jersey rejects ‘guilt by association’ as law enforcement policy and for reaffirming the fundamental constitutional principle that an individual’s guilt or innocence is determined by his conduct and not his ethnic or religious identity.   ADC-NJ furthermore stands ready to assist the State in connection with the training of law enforcement personnel, to ensure that the policies set forth in the Directive are implemented and that the civil rights of New Jersey citizens are preserved.
